This document refers to the protection of natural persons with regard to the processing of personal data and the free movement of such data and is fully governed by Portuguese law.
Loja Augusto assumes a permanent commitment to protecting the privacy of personal data provided by its customers within the scope of the services it provides.
This document aims, therefore, to provide users with the necessary information regarding Loja Augusto’s privacy policy, so that they can give their express, free, and informed consent to the processing of their personal data carried out by Loja Augusto, when requested during the service subscription process.
The customer declares to know and accept the privacy code norms available on the Loja Augusto website, consenting to the publication/disclosure of their personal data.
Personal data provided by users during the process of subscribing to services by Loja Augusto will be processed under the legally and regularly provided terms.
The processing of personal data shall mean any operation or set of operations performed with or without the aid of electronic or automated means, concerning the collection, recording, organization, maintenance, interrogation, preparation, modification, selection, extraction, comparison, use, interconnection, blocking, communication, disclosure, suppression, and destruction of data, whether or not the latter are contained in a database.
The processing of personal data may consist – partly as a consequence of how the customer decides to use the Services – of text files, photographic images or videos, audio tracks, telephone lines, and any other information that can be used to identify the person concerned, according to the type of services requested.
This procedure will respect the principles of legality, good faith, and transparency and will guarantee respect for the rights of users, namely their right to the privacy of their personal life.
Processing Objectives
The objective of this procedure is to allow the provision of services by Loja Augusto in the manner intended by the customer, as well as the independent management of the service by the latter. For this purpose, the customer must register as a user and create their profile when the services are provided by Loja Augusto. Collection, storage, and processing of data for subsequent operations, technical and administrative management of services, and exchange of electronic communications.
The processing of data by Loja Augusto will respect all applicable legal norms, namely in compliance with the tax and accounting obligations that are incumbent upon it.
Users’ personal data will also be processed with the aim of enabling “Web browsing.”
The objective of this processing is also the collection, storage, and organization of the customer’s personal data with a view to carrying out statistical analysis anonymously. This analysis will not allow the identification of the customer and will only be intended to verify the quality of the services provided by Loja Augusto.
Processing Procedures
Personal data of customers will be processed through electronic and automatic means.
Communication and disclosure of common personal data
Common personal data (of a non-sensitive nature) may be communicated by Loja Augusto to:
- Persons and companies that provide legal, tax, financial, and accounting consultancy services to Loja Augusto;
- Institutions, entities, and/or authorities to whom the data must be transmitted under statutory and/or legally provided terms;
- Commercial partners of Loja Augusto, but only if the customer gives their express consent.
Optional or mandatory consent
If the customer does not provide their personal data, the subscribed services may not be activated, this being a decision of Loja Augusto.
The customer’s consent is also optional regarding data processing for the purpose of carrying out market studies, research, and statistical analysis; the sending of advertising and informative material through telephone service providers, through automatic messages without the mediation of an operator, or by fax.
The customer’s consent is also optional for the receipt of unsolicited commercial messages. These must be immediately and unequivocally identified as such and contain an indication that the recipient of the message may in the future refuse to receive messages with that content.
If the customer chooses not to give their express consent to the processing of their personal data for commercial purposes when asked for that purpose, this refusal will not have any consequence regarding the provision of the service by Loja Augusto.
If the customer provides their consent, under the terms described above, they may be admitted to participate in promotional contests organized/promoted by Loja Augusto.
Processing of sensitive data
When the customer uses Loja Augusto’s services, certain personal data classified as sensitive may be processed, particularly data revealing race or ethnic origin, religious, philosophical or other convictions, political opinions, party affiliation, health status, or sexual orientation.
Loja Augusto suggests that the customer does not publish sensitive personal data, except if strictly necessary or if they choose services that do not imply such publication.
In any case and outside exceptional situations, such data may only be published with the express and specific consent of the customer in writing or in another equivalent form.
Based on what has been said above, Loja Augusto reminds that if the customer does not provide their express consent regarding the processing of sensitive data and later intends to use services that imply the processing of sensitive personal data, they will have to previously modify their registration, providing the necessary consent.
If for some reason the customer does not provide their express consent for the processing of sensitive personal data and subsequently subscribes to services that presuppose such processing, Loja Augusto cannot be held responsible, as the disclosure of sensitive data on the web will be the sole responsibility of the customer, regardless of the fact that the management of the Web space is provided by Loja Augusto.
However, Loja Augusto reiterates the aforementioned importance of prior modification of the registration by the customer, granting the necessary authorization for the processing of sensitive data if they intend to use services that necessarily involve the use/processing of such information.
Sensitive data, particularly those revealing the customer’s sexual orientation, will not be communicated (except in cases of legal imposition) or disclosed by Loja Augusto.
Should the customer intentionally use the services provided by Loja Augusto to communicate and/or disclose their sensitive personal data on the internet, such a situation does not represent any conduct accepted or practiced by Loja Augusto, as the customer communicates this information within the scope of the private and independent management they make of the Web space made available to them or within the scope of the normal use of the services provided.
Possible processing of third-party personal data provided by the person concerned
When the customer uses certain services (e.g., promotional activities carried out by Loja Augusto that allow them to request the registration of domain names in favor of third parties), the personal data of third parties provided by the customer to the operator may be processed. In this case, the customer assumes the role of an independent data manager and the inherent legal obligations, namely that of compensation for any damage caused to the third party by violation of norms relating to the protection of personal data. In any case, if the customer provides or processes personal data of third parties while using services provided by Loja Augusto, they guarantee and fully assume that the third party previously authorized the processing of their personal data.
Data Controller and Data Processor
The person responsible for data processing is: Loja Augusto with headquarters at Rua do Terreirinho nº 48, 1100-598 Lisbon, Portugal.
You may contact the data processors, under the terms of the law, at any time by contacting the offices of the data controller – Loja Augusto in order to exercise the rights provided by law.
Data storage and security measures
Data will be stored for the time defined by applicable laws and regulations, on Loja Augusto’s servers. In any case, your data will be stored strictly for the period of time necessary to achieve the objectives mentioned above, which shall correspond to the duration of the contractual relationship between Loja Augusto and the customer. If you cancel your account, as soon as you stop using the Services, your data will be deleted, except when its maintenance is strictly necessary for compliance with legal, financial, tax, and accounting obligations, after the customer ceases using the service. Once these obligations are met, your data will be deleted. We also inform you that these data will be collected, processed, and maintained in full compliance with legal provisions.
Right of access to personal data and other rights
The customer has the right to be informed of:
- the source of the personal data;
- the purposes and methods of processing;
- the logic applied to the processing, namely if it is carried out with the aid of electronic means;
- the identification of the data controller, data processor, and their representatives;
- the entities or categories of entities to whom the personal data may be communicated and who may know such data as designated representative(s) in the territory of the State, processor(s), or person(s) responsible for processing.
The customer has the right to obtain:
a) updating, rectification or, when interested, integration of the data;
b) deletion, anonymization or blocking of data that were processed illegally, including data whose maintenance is necessary for the purposes for which they were collected or subsequently processed;
c) certification to the effect that the operations under points a) and b) were notified to the entities to whom the data were communicated or disseminated, unless this requirement proves impossible or manifestly disproportionate to the right to be protected.
The customer has the right to reject, in whole or in part:
a) for legitimate reasons the processing of personal data concerning them, even if relevant to the purpose of collection;
b) the processing of personal data concerning them, carried out for the purposes of sending advertising material or direct sales, or else for evaluation of market performance or commercial communication.
